Creativeland Asia, WinZo creative idea dispute in Delhi HC; parties agree on arbitrator

Creativeland Asia has moved the Delhi High Court, seeking restraint on WinZo from using the tagline “Jeeto Har Dinzo”. Creativeland Asia alleged that WinZo games had applied to formally register “Jeeto Har Dinzo” in its name as a trademark before the two parties entered into a formal agreement.

Creativeland Asia filed a petition in the Delhi High Court under the Arbitration & Conciliation Act, 1996 gainst WinZo seeking to restrain them from releasing any campaign or communication, in any form or medium comprising “Jeeto Har Dinzo”.

Delhi High Court has suggested appointing an arbitrator o adjudicate upon the disputes between the two parties. It is learnt that both Creativeland Asia and WinZo have agreed to have former Delhi High Court Judge Justice Manmohan Singh act as the Arbitrator for adjudicating the disputes, including trademark and apprehended copyright infringement.
