Britannia wins legal victory in trademark dispute over 'GOOD DAY'

The Delhi High Court has ruled in favor of Britannia Industries in a trademark infringement case against Desi Bites Snack, granting an ex parte injunction to protect its well-known 'GOOD DAY' trademark. The court has prohibited Desi Bites from using the mark 'GOOD DAY' for products like soan papdi and papad, citing potential consumer confusion and harm to Britannia's brand reputation.

Britannia argued that 'GOOD DAY' has become a household name synonymous with high-quality bakery and confectionery products. Backed by a robust market presence, with revenues exceeding ₹16,000 crore and operations spanning over 4.2 million retail outlets nationwide, Britannia claimed that Desi Bites’ use of the same trademark aimed to unlawfully capitalize on its established goodwill.

The company maintained that the unauthorized use of the trademark not only violated intellectual property rights but also created a risk of misleading consumers into believing a false association between the two brands. Britannia emphasized that this infringement could tarnish its reputation and that mere financial compensation would fail to mitigate the damage caused to its brand identity.

Desi Bites, despite being duly notified, did not appear in court, leaving Britannia’s claims uncontested. Justice Mini Pushkarna, presiding over the case, observed that the striking similarity between the marks could confuse consumers and damage Britannia’s goodwill irreparably.

As a result, the court ordered an interim injunction against Desi Bites, barring it and its affiliates from using the 'GOOD DAY' trademark or any similar variation. Additionally, it mandated the removal of infringing products from online platforms, while allowing Desi Bites to continue selling their goods under a non-infringing label.
