MX Player taken to court over non-payment of dues

MX Player has been taken to the Delhi High Court by Culver Max Entertainment Pvt Limited over non-payment of dues for services provided. On May 27, the Delhi High Court directed MX Media to preserve INR 31.25 crore from its sales proceeds.

The petition, filed under Section 9 of the Arbitration and Conciliation Act, 1996, sought interim measures to safeguard the outstanding amount owed by MXP Media India and its affiliates, MX Media Co Ltd (British Virgin Islands) and MX Media & Entertainment Pvt Ltd (Singapore). Sony's petition claimed that MX Media & Entertainment Pvt Ltd terminated the Distribution Agreement and is avoiding payment of the outstanding amount of INR 31.25 crore. The Delhi Court instructed that if MX Media & Entertainment's assets are sold, Sony should be paid the INR 31.25 crore from the proceeds. Additionally, Sony's legal representatives must be informed of any asset sale conclusion.

MX Media & Entertainment Pvt Ltd, registered under Singapore law, is currently undergoing liquidation proceedings before the High Court of Singapore. A winding-up order was issued, but the process was halted until June 20, 2024, following an application by MX Media Co Ltd and MXP Media India Ltd to invalidate the order.

Advocate Gaurav Pachnanda and his team represented Sony in this case.
